Terms of Service

Welcome to RockHillPainters.com. These Terms of Service (“Terms”) govern your access to and use of RockHillPainters.com, including its pages, forms, directory listings, quote-request services, communications, and related features collectively referred to as the “Site.”
The Site is owned and operated by Rock Hill Painters LLC, referred to in these Terms as “RockHillPainters.com,” “we,” “us,” or “our.”
By accessing the Site, submitting a request, contacting a service provider through the Site, or otherwise using the Site, you agree to these Terms. Do not use the Site if you do not agree to them.
1. Nature of Our Services
RockHillPainters.com is a local painting-services website serving Rock Hill, South Carolina, and surrounding communities.
Depending on the circumstances, we may operate in one or more of the following capacities:
Directory and referral service
We may help users locate, contact, or receive estimates from independent painters, painting companies, contractors, subcontractors, or other service providers.
We may forward, share, license, or sell information submitted through the Site to one or more service providers that may be able to respond to the request. We may receive compensation for providing a referral or lead.
Direct painting-service provider
In some situations, we may choose to accept and perform a painting project ourselves, through our employees, or through subcontractors working on our behalf.
Submitting a request through the Site does not automatically create a contractor-client relationship with us. We become the service provider only when we expressly agree to perform the work and the customer accepts a separate written estimate, proposal, work order, or service agreement.
The separate project agreement will control matters such as:
- The scope of work;
- Project pricing;
- Deposits and payment schedules;
- Paint colors, products, and materials;
- Estimated start and completion dates;
- Surface preparation;
- Change orders;
- Warranties;
- Cleanup responsibilities; and
- Cancellation terms.
If a project agreement conflicts with these Terms regarding the actual painting work, the project agreement will control.
2. Quote and Service Requests
When submitting a service request, you agree to provide information that is current, complete, and accurate.
Information you may be asked to provide includes:
- Your name;
- Telephone number;
- Email address;
- Property address or ZIP code;
- Type of property;
- Description of the requested work;
- Project timeframe;
- Photographs;
- Budget information; and
- Other information reasonably necessary to understand the project.
Submitting a request does not guarantee that:
- A painter will contact you;
- A service provider will be available;
- You will receive a particular price;
- A provider will accept the project;
- Work can begin within a particular period; or
- The project will qualify for any advertised offer.
All estimates, prices, and timelines are determined by the service provider after considering the actual property and project requirements.
3. Sharing and Selling Lead Information
By submitting a quote request or service inquiry, you understand and agree that we may share, transfer, license, or sell the information you submit to one or more painters, contractors, subcontractors, service providers, or businesses that may be able to assist with your project.
Those parties may contact you using the telephone number, email address, or other contact information you provide.
We may be compensated for providing your information to a service provider. The amount we receive, if any, does not necessarily affect the price you are quoted.
Your information will be handled as described in our Privacy Policy.
4. Consent to Communications
By submitting your contact information, you authorize RockHillPainters.com and the service providers receiving your request to contact you regarding your inquiry.
Communications may include:
- Telephone calls;
- Text messages;
- Emails; and
- Voicemail messages.
Message and data rates may apply.
Your consent applies to communications relating to your request, estimates, scheduling, project follow-up, and related services. Consent to receive marketing communications is not a condition of purchasing painting services.
You may request that communications stop by replying STOP to a text message, using an unsubscribe link in an email, or directly informing the caller or sender that you no longer wish to be contacted.
We are not responsible for communications independently initiated by a third-party provider after your information has been transferred, although you may contact us if you believe a provider is misusing your information.
5. Independent Service Providers
Unless we expressly state in writing that RockHillPainters.com is the contractor responsible for a particular project, painters and other businesses listed on or contacted through the Site are independent service providers.
Independent providers are not our employees, agents, partners, or representatives. They independently control their:
- Pricing;
- Estimates;
- Availability;
- Work methods;
- Employees and subcontractors;
- Tools and materials;
- Insurance;
- Registrations and licenses;
- Warranties; and
- Customer agreements.
We do not control or supervise an independent provider’s work.
A listing, referral, featured placement, advertisement, review, or introduction does not constitute a guarantee, certification, or endorsement of a service provider.
6. Provider Qualifications
We may review certain publicly available or provider-supplied information, but we do not guarantee that every provider’s information is complete, current, or accurate.
Before hiring an independent provider, you should conduct your own evaluation. This may include requesting and verifying:
- Business registration;
- Applicable contractor registration or licensing;
- General liability insurance;
- Workers’ compensation coverage;
- References;
- Written estimates;
- Written warranties;
- Applicable permits; and
- A written description of the work.
You are solely responsible for deciding whether to hire an independent service provider.
7. Agreements with Independent Providers
Any contract for work performed by an independent provider is solely between you and that provider.
RockHillPainters.com is not a party to that agreement unless we expressly identify ourselves in writing as the contractor responsible for the project.
Any concerns involving an independent provider’s pricing, performance, delays, property damage, payment terms, warranty, conduct, or workmanship must be addressed directly with that provider.
8. Projects Performed by Us
When we accept a project directly, our obligations will be described in a separate written estimate, proposal, work order, or service agreement.
We may use employees or qualified subcontractors to complete some or all of the work.
Unless otherwise stated in the applicable project agreement:
- Additional work requires written approval;
- Changes may affect the price and timeline;
- Hidden damage or unsuitable surfaces may require additional work;
- Color appearance can vary based on lighting, sheen, surface texture, and surrounding materials;
- Exact color matching is not always possible;
- Customer delays may affect scheduling;
- The customer must provide reasonable access to the property; and
- Project-specific warranties apply only as stated in writing.
No verbal statement creates a warranty or changes a written project agreement.
9. Directory Listings and Advertisements
Some providers may pay for featured placement, advertising, enhanced listings, lead access, or other promotional services.
Paid placement does not mean that a provider is necessarily more qualified than another provider. Directory order and visibility may be influenced by factors including location, availability, listing completeness, compensation arrangements, and relevance to the user’s request.
10. Reviews and User Content
The Site may allow users to submit reviews, comments, photographs, project details, or other content.
By submitting content, you represent that:
- You have the right to submit it;
- It is based on your genuine experience;
- It is accurate to the best of your knowledge;
- It does not violate another person’s privacy;
- It does not infringe intellectual-property rights;
- It is not fraudulent, defamatory, threatening, or unlawful; and
- It does not contain malicious software or deceptive links.
You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, display, edit, format, distribute, and publish submitted content for operating and promoting the Site.
We may remove or decline to publish content at our discretion.
11. Acceptable Use
You may not use the Site to:
- Submit false, fraudulent, or misleading requests;
- Impersonate another person;
- Harass service providers or users;
- Collect information about other users;
- Send spam or unauthorized advertisements;
- Interfere with the Site’s operation or security;
- Introduce viruses, malware, or harmful code;
- Scrape or copy directory information through automated means;
- Attempt to gain unauthorized access to the Site;
- Use Site content to create a competing database or directory; or
- Violate any applicable law or regulation.
We may restrict or terminate access for suspected misuse.
12. Intellectual Property
The Site and its original content—including its name, logo, design, text, graphics, directory structure, forms, photographs, and software—are owned by or licensed to us and are protected by applicable intellectual-property laws.
You may use the Site only for personal or legitimate business purposes related to locating or requesting painting services.
You may not reproduce, republish, sell, distribute, modify, scrape, or commercially exploit Site content without our written permission.
Names, logos, photographs, and materials belonging to listed providers remain the property of their respective owners.
13. Third-Party Websites and Services
The Site may contain links to third-party websites, maps, review platforms, payment services, social-media services, or other resources.
We do not control and are not responsible for third-party content, security, privacy practices, products, services, or availability. Accessing a third-party service is at your own risk and subject to that party’s terms and policies.
14. No Guarantee of Results
We do not guarantee:
- The availability of any painter or contractor;
- That a provider will respond to a request;
- The accuracy of every directory listing;
- The quality or outcome of independently provided work;
- That estimates will match final prices;
- That a project will be completed by a particular date;
- That the Site will be uninterrupted or error-free; or
- Any particular improvement in property value or appearance.
Project outcomes depend on numerous factors, including the property’s condition, preparation, materials, weather, customer selections, provider performance, and changes to the scope of work.
15. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and its directory, referral, and quote-request services are provided on an “as is” and “as available” basis.
We disclaim all implied warranties relating to the Site, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
This disclaimer does not eliminate warranties expressly provided in a separate written agreement for painting services performed directly by us.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
16. Limitation of Liability
To the fullest extent permitted by law, RockHillPainters.com and its owners, officers, employees, affiliates, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:
- Use of or inability to use the Site;
- Reliance on directory information;
- Communications from an independent provider;
- The acts or omissions of an independent provider;
- A dispute between a customer and an independent provider;
- Unauthorized access to information; or
- Loss of data, profits, business opportunities, or goodwill.
For claims arising solely from our directory, referral, or lead-generation services, our total liability will not exceed the greater of the amount you paid directly to us for use of those services during the preceding six months or one hundred dollars.
This limitation does not apply to payment obligations, liability that cannot legally be limited, or claims governed by a separate written agreement under which we directly perform painting services.
17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless RockHillPainters.com and its owners, employees, affiliates, and representatives from claims, damages, liabilities, losses, and reasonable legal expenses arising from:
- Your misuse of the Site;
- False information submitted by you;
- Content submitted by you;
- Your violation of these Terms;
- Your violation of another person’s rights; or
- Your unlawful conduct.
This provision does not require a consumer to indemnify us for our own negligence or unlawful conduct where such an obligation is prohibited by law.
18. Privacy
Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
You should review the Privacy Policy before submitting personal information.
19. Electronic Communications
You agree that agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that those communications be in writing, to the extent permitted by applicable law.
You are responsible for maintaining an accurate email address and telephone number.
20. Termination
We may suspend or terminate access to the Site when we reasonably believe a user has:
- Violated these Terms;
- Submitted fraudulent requests;
- Interfered with Site operations;
- Threatened another user or provider; or
- Engaged in unlawful activity.
Sections that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnification, and dispute provisions—will remain in effect.
21. Governing Law and Venue
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.
Before filing a legal claim, you agree to contact us and make a good-faith effort to resolve the dispute informally.
Unless applicable law requires otherwise, any legal proceeding relating to the Site or these Terms must be filed in a court of competent jurisdiction located in York County, South Carolina.
Nothing in these Terms prevents either party from bringing an eligible claim in small-claims court.
22. Changes to These Terms
We may update these Terms periodically.
When changes are made, the revised version will be posted on this page with a new effective date. Continued use of the Site after revised Terms are posted constitutes acceptance of those Terms.
Material changes will apply prospectively unless applicable law permits otherwise.
23. Severability
If any provision of these Terms is found unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
24. No Waiver
Failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
25. Entire Agreement
These Terms, the Privacy Policy, and any applicable written project agreement constitute the entire agreement concerning the matters they address.
A project-specific estimate, proposal, work order, or service agreement may contain additional terms governing painting work performed directly by us.
